According to ENR, two Ohio asphalt companies will pay $30 million to settle federal allegations of submitting false test results to the state Department of Transportation for road projects. Kokosing Materials Inc. will pay $17.5 million and Barrett Paving Materials Inc. will pay $12.5 million to resolve claims they repeatedly submitted copied data from previous tests instead of conducting required mix-design testing on federally funded projects from 2012-2025.

What It Means for Subcontractors

  • Testing compliance is now under federal scrutiny with hefty penalties, making proper documentation and quality control procedures essential for any contractor working on government projects
  • The settlements show regulators are actively investigating testing fraud through whistleblower complaints, meaning employees or competitors could report suspected violations
  • Companies working on federally funded projects should review their testing protocols and documentation practices to avoid similar False Claims Act exposure
