California Data Center Electrical Rooms Face Two Confined-Space Rules

Federal OSHA 1926.1203 and California's Title 8 confined space standard both apply to Bay Area data center electrical rooms, and one doesn't satisfy the other. Electrical and mechanical subs should plan for surveys, rescue plans and training before mobilizing.

California Data Center Electrical Rooms Face Two Confined-Space Rules

California data center electrical rooms now sit under two confined-space regimes, federal OSHA 1926.1203 and Californiaโ€™s Title 8 standard, and neither substitutes for the other, ISHN reports.

Market Impact

Electrical rooms feeding switchgear, UPS units and power distribution equipment meet the permit-required confined space definition more often than general contractors assume, the ISHN article says. The test is a space large enough to enter, with restricted entry or exit, not designed for continuous occupancy. Cable tray and conduit runs that push access points 12 to 18 feet above the finished floor make the fit more likely. The federal rule covers entry permits, atmospheric testing and attendant duties.

Californiaโ€™s updated Title 8 standard (Sections 1951 through 1956, 1960 and 5156) took effect January 1, 2026. It requires a competent person to survey for confined spaces before construction starts, then resurvey often enough to catch spaces created as the project progresses. ISHN notes that a space open in week one can become permit-required by week six as trades overlap. Energized switchgear traps heat in a room without commissioned HVAC, and UPS battery rooms can off-gas from lead-acid or lithium-ion cells during charging and testing. ISHN says that potential for a hazardous atmosphere is enough to trigger the standard.

ISHN says Cal/OSHA records donโ€™t yet show a Bay Area data center electrical room case. It points to a 2023 Cal/OSHA action in Southern California, involving a worker who suffocated in a 10,000-gallon tank, where investigators found no hazard inspection and no rescue plan.

What It Means for Subcontractors

  • Electrical subs (cable tray, switchgear, UPS): Before mobilizing on a California job, ask the GC for the competent person survey and how reclassifications will be tracked. ISHN suggests tying resurveys to cable tray rough-in, switchgear set and UPS commissioning.
  • Rescue planning: A plan written for a ground-level vault doesnโ€™t carry over to a switchgear room entered by a fixed ladder or scaffold stair 15 feet up. ISHN says retrieval equipment and training differ for elevated entry. Our inference: price rescue equipment, rescue training and attendant labor as separate bid lines, not overhead.
  • Scaffold and access crews: Fall protection applies above 10 feet regardless of confined space status, per ISHN. Build the access structure and entry plan from the same site walk-through, not from separate subs on separate schedules.
  • Mechanical subs: Ductwork can seal in a space that was open at the walk-through. Ask who the GC has named as accountable for reclassification across the full electrical room scope, since ISHN says the survey often lands with whichever trade mobilizes first.
  • Next gate: This is a compliance story, not a bid stage. Title 8 has been in effect since January 1, 2026, so any California package priced without survey, permit and rescue costs is exposed. Check Cal/OSHAโ€™s employer guidance on permit spaces, which ISHN recommends as the base for each tradeโ€™s plan.
